New tank Inspection & Certification agreements in place for ADR transport operators

Multilateral Agreement M325 concerning periodic or intermediate inspections of tanks and certificates of approval for vehicles 

In response to the current unprecedented circumstances regarding COVID-19, the Government of Luxembourg initiated Multilateral Agreement M325 concerning periodic or intermediate inspections of tanks in accordance with 6.8.2.4.2, 6.8.2.4.3, 6.8.3.4.6, 6.8.3.4.12, 6.9.5.2 and 6.10.4 of ADR, and certificate of approval for vehicles in accordance with 9.1.3.4 of ADR.  The Health & Safety Authority, the competent authority in Ireland for ADR, has signed the agreement (attached), which has also been co-signed by the Governments of eighteen other Contracting Parties to the ADR.

Under this agreement, periodic or intermediate inspections of tanks that are due to expire between 1 March 2020 and 1 August 2020 remain valid until 30 August 2020.  The inspections must be undertaken before 1 September 2020.  Also under this agreement, all certificates of approval for ADR vehicles, the validity of which end between 1 March 2020 and 1 August 2020, remain valid until 30 August 2020.  The technical inspections required for the issue of such prolonged certificates must be undertaken in accordance with 9.1.2.3 of ADR before 1 September 2020.  The validity period of the certificate according to 9.1.3.5 of ADR shall begin with the last date of expiry mentioned on the certificate to be prolonged or renewed.

This agreement is valid until 1 September 2020.

Under section 1.5.1 of ADR concerning periodic or intermediate inspections of tanks in accordance with 6.8.2.4.2, 6.8.2.4.3, 6.8.3.4.6, 6.8.3.4.12, 6.9.5.2 and 6.10.4 of ADR, and certificate of approval for vehicles in accordance with 9.1.3.4 of ADR

(1) By derogation from the provisions of 6.8.2.4.2, 6.8.2.4.3, 6.8.3.4.6, 6.8.3.4.12, 6.9.5.2 and 6.10.4 of ADR all periodic or intermediate inspections of tanks the validity of which ends between 1 March 2020 and 1 August 2020 remain valid until 30 August 2020. These inspections shall be undertaken in accordance with 6.8.2.4.2, 6.8.2.4.3, 6.8.3.4.6, 6.8.3.4.12, 6.9.5.2 or 6.10.4 of ADR before 1 September 2020. The related marking shall be in conformity with 6.8.2.5.1 or 6.8.3.5.10 of ADR.

(2) By derogation from the provisions of 9.1.3.4 of ADR all certificates of approval the validity of which ends between 1 March 2020 and 1 August 2020 remain valid until 30 August 2020. These technical inspections shall be undertaken in accordance with 9.1.2.3 of ADR before 1 September 2020. The validity period of the certificate according to 9.1.3.5 of ADR shall begin with the last date of expiry mentioned on the certificate to be prolonged or renewed.

(3) This agreement shall be valid until 1 September 2020 for carriage on the territories of the ADR Contracting Parties signatory to this Agreement. If it is revoked before that date by one of the signatories, it shall remain valid until the abovementioned date only for carriage on the territories of those ADR Contracting Parties signatory to this Agreement which have not revoked it.
